Cancellation Policy

In case of cancellation by the client or reduction of reserved spots, as long as the minimum group size for the activity is maintained:

IF NOTIFIED MORE THAN 1 MONTH IN ADVANCE, 25% of the total reservation or the corresponding cost for the canceled spots will be charged for administrative expenses.

IF NOTIFIED BETWEEN 1 MONTH AND 6 DAYS BEFORE: 50% of the total reservation or the corresponding cost for the canceled spots will be charged for administrative expenses.

IF NOTIFIED BETWEEN 5 DAYS AND 1 DAY BEFORE: 75% of the total reservation or the corresponding cost for the canceled spots will be charged for administrative expenses.

IF NOTIFIED WITH LESS THAN 24 HOURS OR NO SHOW AT THE AGREED PLACE, TIME, AND DATE INDICATED IN THE RESERVATION FORM: 100% of the reservation or the corresponding cost for the canceled spots will be charged for administrative expenses.

DURATION OF VOUCHERS
The vouchers or reservations for surf courses or classes paid in advance have a duration of one year from the date of making the reservation. After the expiration date of the vouchers, they will no longer be valid and will need to be renewed as a new purchase.

Failure to show up at the agreed place, date, and time stated in the reservation form will not entitle to any kind of refund. Likewise, if the company suspends the activity because customers show clear signs of being under the influence of alcohol and/or drugs, it does not entitle to any refund.

With the confirmation of the reservation, it is assumed that all the sections contained in these General Conditions of Activities have been accepted. The registration of other individuals implies that all the registered persons also assume these General Conditions.

For any complaint, in addition to the existence of a complaints book, you can contact the company’s Reservation Center.

The activities offered by ONDAS NOVAS are carried out in the Natural Environment, which is why we must take utmost care of the surroundings where we conduct them and avoid, by all means, leaving any noticeable trace of our presence in those places. Therefore, all participants must follow the instructions given by the Guides and Instructors in this regard.

General conditions

  • You wish to participate in the surf course under the conditions established by the organizer. In this regard, you have been informed and accept the general and specific conditions under which the surf courses are organized, as presented by the organizer, including matters related to the price and the procedure in the event of suspension, cancellation, or interruption of the courses due to force majeure or unforeseen circumstances.

  • You are informed and give your consent to the inclusion of your data in the existing automated files and to their automated processing, as well as any data that the organizer may have access to as a result of your participation in the courses. The organizer ensures, in any case, the exercise of the rights of access, rectification, cancellation, and opposition, in accordance with the terms established in the current legislation, which can be exercised through a written request addressed to the headquarters or establishment of the organizer. The personal data provided are stored in an automated file registered in the R.G.P.D. of the Spanish Agency for Data Protection.

  • This exempts the organizer from any liability for any injuries or damages, whether physical or of any other kind (including material damages), not attributable to poor organization or functioning for which the organizer should be civilly responsible.

  • This authorizes the organizer to fully or partially record and subsequently use for advertising purposes in the broadest terms as permitted by law, their presence or participation in the courses through photographs, films, television, radio, video, and any other known or unknown media, as well as the right to use them for commercial and advertising purposes, etc., as they deem appropriate, without any right to financial compensation.

  • That they are aware of the physical demands involved in participating in a surf course and, in this regard, declare that they do not have any contraindication, health problem, or injury that would prevent them from taking part in the aforementioned sports activity, exonerating the organizer in any case from any situation arising from possible health issues of any kind that may arise for the participant due to their participation in the event.

  • Ondas Novas accepts payment for purchases made through its website with the following credit or debit cards: Visa, Visa Electron, MasterCard, and Maestro.

  • The charge will be made online, in real-time, through the corresponding financial entity’s payment gateway, once it has been verified that the provided data is correct.

  • The cardholder is responsible for the transactions on the website.

  • We guarantee that each transaction made on ondasnovas.com is 100% secure. All operations involving the transmission of personal or banking data are conducted using a secure environment.

  • Ondasnovas.com uses a server based on SSL (Secure Socket Layer) security technology, which is a standard encryption method. All the information transmitted by the user travels encrypted through the network.

  • The data of your credit card is not recorded in any database but goes directly to the TPV (Point of Sale Terminal) of Cecabank.

  • Furthermore, we inform you that, in an effort to provide greater security to credit card owners, we have incorporated the secure payment system called CES (Secure Electronic Commerce) into our payment gateway. This way, if the user owns a “secured” card, they will always be able to make payments with VISA or MASTERCARD in our store.

  • In case your card is not enrolled in this payment system,

  • Ondas Novas will only accept payment by VISA or MASTERCARD credit cards from customers with proven previous seniority and reliability.

  • In both cases, when paying with VISA or MASTERCARD, the following information will always be requested: the card number, expiration date, and a Validation Code that corresponds to the last 3 digits of the number in italics on the back of your VISA or MASTERCARD card, thus providing more guarantees about the security of the transaction.

  • Credit card fraud is a crime, and

  • Ondas Novas will take legal action against anyone who makes a fraudulent transaction on our online store.

2. Bank transfer

Once the order is processed, we will provide a bank account number for you to make the bank transfer. For this, it will only be necessary to indicate the order number as the payment reference. The order will be shipped once the amount has been received in our account (please note that this process may take up to 72 business hours). The payment must be completed within 7 natural days following the order, otherwise it will be automatically canceled.

Shipping and Transportation

SHIPPING AND TRANSPORTATION COSTS
Ondasnovas.com makes shipments by charging an amount in euros for shipping costs according to the destination and product.

SHIPMENTS
Shipments will be delivered by the transport company within an estimated time from the date of dispatch of 24/48 hours for shipments made to the mainland and Balearic Islands, and within a period of 7 to 10 days for shipments to the Canary Islands, Ceuta, and Melilla. Ondasnovas.com is not responsible for delays caused by external factors, the transport company, or the local carrier.

Right of Withdrawal, Returns, and Complaints

The buyer shall have a minimum period of fifteen natural days to exercise the right of withdrawal, starting from the day the customer receives the product, without any penalty and without the need to provide any reasons. The exercise of the right of withdrawal must be carried out through notification via telephone communication to +34 722 155 665, or by contacting the email address info@ondasnovas.com, or by sending a written notice to our postal address, Av. Souto Vizoso 40 Valdoviño 15552 Coruña. As stated in Article 103 of Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users, the supply of services or goods made according to the consumer’s specifications or clearly personalized, or goods that, by their nature, cannot be returned or may deteriorate or expire rapidly, are exempt from withdrawal. The return will be handled by ondasnovas.com, they will collect the product. The customer will be responsible for the return shipping costs of the product. In any case, the products to be returned must be in perfect condition, unused, and in their original packaging. Therefore, we kindly request that to avoid any issues during transportation, please ensure that the package is properly protected and sealed. Once received, we will check their condition. At the moment we verify that both the item(s), as well as any possible components, accessories, promotional gifts, and documentation, are complete and in perfect condition, we will proceed to refund the amount paid.

REFUND OF PAYMENT
In the event of unjustified delays on the part of ondasnovas.com regarding the refund of the amounts paid, the customer may claim the paid sums, without prejudice to the right to be compensated for damages suffered that exceed said amount.

RETURN OF DEFECTIVE PRODUCT

In the event that the product is not in good condition, and the causes for this are not attributable to the customer, the customer will have the right to return the product, informing ondasnovas.com of the reason for the return through any of the means provided in the current terms of contract, and at no cost to the customer. This return due to a defect or poor condition of the product will not be considered a right of withdrawal. ondasnovas.com commits to bear the cost of the return and replace the product with a new one according to the conditions accepted at the time of sale. JURISDICTION
Likewise, ondasnovas.com reserves the right to take civil or criminal actions it deems appropriate for the improper use of its website and content or for non-compliance with these terms and conditions. The relationship between the user and the provider will be governed by the current laws and regulations applicable in the Spanish territory. If any dispute arises, the parties may submit their conflicts to arbitration or resort to the ordinary jurisdiction, complying with the rules on jurisdiction and competence. ondasnovas.com has its registered office in A Coruña, Spain.
